1. Acceptance of Terms

By accessing or using the Innovative Academy website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

Account Responsibilities

• You are responsible for safeguarding the password that you use to access the Service.
• You agree not to disclose your password to any third party.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
• You may not use the account of another user at any time.

3. Products and Services

Our services include the sale of digital exam papers and the booking of remedial lessons.

A. Digital Products (Exam Papers)

• All digital papers are provided "as is".
• Due to the nature of digital goods, all sales are final and non-refundable once the file has been downloaded or accessed.
• You are purchasing a single-user license. Sharing or redistributing the downloaded papers is strictly prohibited.

B. Remedial Lessons

• Lesson bookings are confirmed upon payment via M-Pesa.
• Sessions are conducted via Zoom or Google Meet as specified at the time of booking.
• Cancellations must be made at least 24 hours prior to the session to qualify for rescheduling. No-shows are non-refundable.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Innovative Academy and its licensors. The materials contained in this website are protected by copyright and trademark laws.

Usage Restrictions

• You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any material from our website.
• Exam papers purchased are for personal educational use only and may not be uploaded to other websites or shared on WhatsApp groups.

5. User Conduct

As a condition of your use of the Service, you warrant to Innovative Academy that you will not use the Service for any purpose that is unlawful or prohibited by these Terms.

You agree not to:

• Use the service for any fraudulent purpose, or to solicit others to perform or participate in any unlawful acts.
• Upload viruses or any other code that disrupts the functionality of the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. Limitation of Liability

To the fullest extent permitted by law, Innovative Academy, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for:

• Any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.
• Any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
